Terms and Conditions

These Terms and Conditions govern use of the Avella Interiors website and purchases from Avella Interiors. By using the website, placing an order, paying an invoice, or accepting delivery, you agree to these Terms.

“Avella Interiors,” “Avella,” “we,” “our,” and “us” refer to Avella Interiors. “You,” “customer,” and “purchaser” refer to the person or entity using the website or purchasing a product or service.

Website Use

The website may be used only for lawful personal or business purposes. You may not engage in fraudulent activity, interfere with website security or operation, gain unauthorized access, scrape or commercially exploit content, or misrepresent your identity or authority. We may restrict access when we reasonably believe these Terms have been violated.

Product Information and Handmade Variations

We make reasonable efforts to provide accurate descriptions, photographs, measurements, prices, colors, and availability, but errors or omissions may occur. Avella Interiors may correct information or cancel an affected order. If we cancel a paid order because of a material pricing or product-information error, we will refund the amount paid for the canceled item.

Avella furniture is handcrafted. Variations in dimensions, shape, color, sheen, texture, grain, woven fibers, seams, distressing, and finish are inherent to handmade furniture and natural materials. Measurements are approximate unless expressly guaranteed in writing. These characteristics are not defects when they do not materially affect reasonable structure or function.

Color Representation and Customer Approvals

Photography, lighting, surrounding décor, monitor settings, paint formulation, substrate, material, and sheen may affect color appearance. Avella Interiors does not guarantee an exact match to a digital or printed image, paint card, sample, prior production run, or another furnishing.

The purchaser is responsible for approving colors, dimensions, finishes, quantities, hardware, delivery information, and other custom details before production.

Orders, Payment, and Acceptance

An order confirmation, invoice, or receipt acknowledges that an order was received; it does not require Avella Interiors to complete an order affected by a pricing error, product unavailability, suspected fraud, production limitation, shipping restriction, or other reasonable business concern.

Payment is due as stated at checkout or in the applicable invoice, proposal, or written agreement. Avella Interiors may pause production or delivery while an amount remains unpaid. Taxes, customization charges, delivery fees, storage fees, redelivery fees, and other approved charges are the purchaser’s responsibility.

Made-to-Order Products, Returns, and Lead Times

Custom and made-to-order products are final sale and cannot be returned or exchanged. Changes and cancellations are governed by the Return and Cancellation Policy.

Production and delivery dates are estimates. Reasonable delays caused by materials, production volume, curing, weather, carrier schedules, labor disruptions, supply-chain events, governmental action, natural disasters, or circumstances outside our control do not automatically permit cancellation of a final-sale order.

Shipping, Delivery, and Inspection

Orders are subject to the Shipping and Delivery Policy. The purchaser is responsible for accurate delivery information, access and measurements, availability to receive the order, inspection at delivery, and prompt reporting of any concern. Delivery is generally provided by independent third parties.

Acceptance, Resale, and Third-Party Transfers

Once delivery has been accepted, the purchaser is responsible for the product’s handling, storage, transportation, installation, use, and any later sale or transfer. Avella Interiors is not responsible for damage, defects, or claims arising after acceptance, including claims related to post-delivery handling, relocation, installation, storage, resale, use by a subsequent owner, or another third party.

Our contractual and customer-service relationship is with the original purchaser, not a downstream buyer. For trade and wholesale purchases, the dealer or trade account is responsible for resale, delivery, installation, client communication, and customer-service matters involving its client. Any claim to Avella Interiors must be submitted by the original purchasing dealer and remains subject to the applicable policies.

Care and Product Concerns

Purchases are governed by the Return and Cancellation Policy and Shipping and Delivery Policy. Customers must follow all care instructions provided with the product or on the website. Delivery damage and verified craftsmanship concerns will be reviewed individually in accordance with those policies.

The Original Lacquer and Woven Collections are intended primarily for indoor residential use. Portico tables are water resistant, not waterproof, and should not be exposed to rain, standing water, storms, prolonged moisture, or uncovered outdoor storage. Improper use or care may cause damage for which Avella Interiors is not responsible.

Antique and Vintage Finds

Antique and vintage pieces are sold as-is and may show age, wear, repairs, patina, variation, or prior use. Descriptions reflect Avella Interiors’ reasonable observations and are not professional appraisals or guarantees of age, provenance, maker, or value unless expressly stated in writing.

Trade Accounts, Promotions, and Gift Cards

Trade pricing is available only to approved professionals who provide requested business and resale documentation. Discounts may vary by collection, may not be combined unless approved, and do not alter final-sale, care, delivery, or claim requirements. The trade-account holder remains responsible for payment and for communicating applicable policies and care instructions to its client.

Promotions may be limited by product, customer, date, quantity, or collection and generally cannot be combined, applied retroactively, transferred, or redeemed for cash. Gift cards are nonrefundable, are not redeemable for cash except where required by law, and cannot be replaced if lost or used without authorization.

Intellectual Property and Customer Content

The Avella Interiors name, logo, product names and designs, photographs, graphics, written content, and website layout are owned by or licensed to Avella Interiors and may not be copied or commercially used without written permission.

By sending photographs, reviews, comments, or other content, you represent that you have the right to provide it. Avella Interiors will not use identifiable photographs of a customer’s home for marketing without permission, except as otherwise permitted by the Privacy Policy.

Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the website and products are provided on an as-available and as-sold basis, subject to rights that cannot legally be excluded. Avella Interiors does not provide a separate written product warranty.

To the fullest extent permitted by law, Avella Interiors’ total liability arising from a product, order, website use, or related transaction will not exceed the amount paid for the product or service giving rise to the claim. Avella Interiors is not liable for indirect, incidental, special, exemplary, or consequential damages, including loss of use, profits, business, temporary furniture, moving expenses, or damage caused by improper installation, care, use, storage, transportation, or relocation. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

Governing Law and General Terms

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, proceedings relating to these Terms or a purchase will be brought in a court of competent jurisdiction in Harris County, Texas.

If a provision is found unenforceable, the remaining provisions remain in effect. A delay or failure to enforce a provision is not a waiver. Avella Interiors may update these Terms periodically; the version in effect when an order is placed will generally govern that order unless required by law or agreed in writing.
